These General Terms and Conditions of Sale (the “General Terms and Conditions of Sale”) are entered into between, on the one hand, AKVO, a simplified joint-stock company with a capital of €2, registered with the Paris Trade and Companies Register under number 899 339 170, with its registered office at 535 Route des Serres, 06570 St Paul (hereinafter referred to as “AKVO”), and on the other hand, any Customer who has made a purchase on the Website. Any purchase on the Website automatically implies full acceptance of the General Terms and Conditions of Sale, which the Customer acknowledges having read before placing an order.
AKVO reserves the right to modify the General Terms and Conditions of Sale at any time. The date of the last update is indicated at the top of the page. Each time a Customer places an order on the Website, the General Terms and Conditions of Sale in effect at the date of the order will apply.
1. DEFINITIONS – INTERPRETATION
For the purposes of these General Terms and Conditions of Sale, capitalized terms not otherwise defined in any article shall have the meanings set forth below:
- Customer: Refers to any internet user, Consumer, or Non-professional, who places an order for Product(s) on the Website.
- Consumer: Refers to any natural person who purchases Products for purposes that do not fall within the scope of their commercial, industrial, artisanal, liberal, or agricultural activity.
- Non-professional: Refers to any legal entity that places an order for Product(s) on the Website for non-professional purposes.
- Party(ies): Refers to AKVO and/or the Customer.
- Product(s): Refers to AKVO products that can be ordered on the Website.
- Website: Refers to www.akvoshop.com and all its pages.
- Territory: Refers to the European Union
2. CUSTOMERS
Sales are made on a retail basis for strictly personal use. AKVO reserves the right not to fulfill any order that appears to contradict personal or non-professional needs, particularly concerning the volume of products ordered, even if the order was initially validated on the Website.
To place an order, the Customer can either (i) create a customer account by completing a registration form or (ii) place an order as a guest.
The Customer must provide accurate, up-to-date, and complete personal information, including their name, phone number, and email address. AKVO shall not be held responsible for any incorrect information provided by the Customer, especially if it results in errors during delivery. If any information changes after registration, the Customer must immediately update their account online or, if they ordered as a guest, notify AKVO without delay by sending an email to support@akvoshop.com, specifying the order number.
Furthermore, when placing an order, the Customer must provide valid banking details. The Customer declares and guarantees that the banking information provided is accurate and that they are the rightful owner of the payment details used for the purchase.
The use of the Website is reserved for individuals who have the legal capacity to contract. By placing an order, the Customer declares that they are legally capable of entering into a contract. AKVO shall not be held responsible if a minor or legally incapacitated person purchases a product without supervision or authorization.

3. PRODUCTS
4. PRODUCT CHARACTERISTICS
By clicking on each product, the Website provides the Customer with a detailed description of all the Products offered for sale by AKVO. In accordance with Article L. 111-1 of the French Consumer Code, the Customer can review the essential characteristics of the Products before placing an order. These descriptions are available in both French and English. Additional information can also be found in the “FAQ” section.
The Products available for sale on the Website are subject to stock availability. However, AKVO may not be able to sell certain products outside the Territory, and such orders will not be accepted for delivery outside the specified regions.
If a Product ordered by the Customer is unavailable, AKVO will inform them as soon as possible and cancel the order. The Customer will receive a full refund for the unavailable Product and any associated shipping fees within fourteen (14) days of payment. However, if only part of the Customer’s order is unavailable, shipping costs for available and delivered Products will not be refunded.
5. PRODUCT COMPLIANCE
The Products sold on the Website and their labeling comply with French and European regulations in effect at the time of sale.
6. PRICES
All prices displayed on the Website include all applicable taxes. Product prices are listed in euros. AKVO reserves the right to modify prices without notice. The prices applied to the Customer correspond to those displayed on the Website at the time of order placement. Products remain the full property of AKVO until full payment is received.
The total amount payable for an order consists of:
- The sum of the prices of each Product ordered as indicated on the Website at the time of purchase.
- The shipping costs determined according to the conditions outlined in Article 4
Payment is required at the time of order. Accepted payment methods include credit card, PayPal, and Apple Pay.
AKVO has implemented a secure payment system for all orders placed on the Website. Payments are processed via Shopify’s payment platform, which incorporates the latest 3D Secure measures.
For certain countries within the Territory, Customers may be required to pay customs duties or other applicable import fees in addition to the order total.
7. DELIVERY AND RECEIPT OF PRODUCTS

AKVO only delivers Products to countries within the defined Territory. Orders are shipped from AKVO’s warehouse within five (5) business days, subject to stock availability. Shipping is handled by carriers such as Colissimo, Chronopost, and FedEx.
Customers receive an email notification when their package is handed over to the carrier, along with a tracking number to monitor the shipment in real time. Depending on the delivery option chosen at checkout, the order is either delivered to the Customer’s home or a designated pickup point.
If the package cannot be delivered, the carrier will leave a notice indicating where the Customer can collect the parcel upon presenting valid identification.
9. DELIVERY TIME AND COSTS
Estimated delivery times are as follows:
France (Metropolitan)
- Pickup point (Colissimo): €7 (free for orders over €300), 3-5 business days.
- Home delivery (Colissimo, no signature): €10 (free for orders over €300), 2-3 business days.
- Home delivery (Chronopost, with signature): €15 (free for orders over €300), next-day delivery (excluding weekends and holidays).
International
- Europe
- Pickup point (Chronopost, with signature): €20 (free for orders over €400), 4-8 business days.
- Pickup point (Chronopost, with signature): €20 (free for orders over €400), 4-8 business days.
For deliveries outside France and the EU, shipping fees are billed excluding VAT. Delivery times are estimates and may vary by location and product availability.
If a package is not delivered within thirty (30) days, the Customer may cancel their order for a full refund.
10. RECEIPT OF PRODUCTS AND CLAIMS
The Customer is required to check the condition of the delivered Products. If a Product is defective or non-compliant, the Customer must follow the procedure set out in Article 6 of the General Terms and Conditions of Sale to return the Product to AKVO within fourteen (14) days of delivery and obtain a refund.
After this period, and if the required formalities have not been followed, the Products will be deemed to be compliant and free of any apparent defects, and no claim will be validly accepted by AKVO, subject to the provisions of Article 7 of the General Terms and Conditions of Sale.
AKVO will refund or replace, as soon as possible and at its own expense, any Products delivered that have proven defects of conformity or apparent or hidden defects, as duly demonstrated by the Customer, in accordance with the provisions of Articles L 217-4 and following of the French Consumer Code and the present General Terms and Conditions of Sale.
11. RIGHT OF WITHDRAWAL AND TIME LIMITS
The Customer has a period of fourteen (14) days to exercise their right of withdrawal. Within fourteen (14) days from the date of receipt of the order, the Customer may request an exchange or refund of the purchased Product(s). If the fourteen (14) day period ends on a Saturday, Sunday, or public holiday, it is extended until the next working day.
12. PROCEDURE FOR EXERCISING THE RIGHT OF WITHDRAWAL
To exercise the right of withdrawal, the Customer must inform AKVO of their decision within fourteen (14) days of receiving the delivery by sending an email to support@akvoshop.com. The Customer must include in the correspondence (i) the order number and (ii) the reason for the return.
Once AKVO has been informed of the Customer’s decision, the Customer must return the Product(s) within fourteen (14) days from the date of the withdrawal notification to the following address:

The Customer may return the Product(s) either (i) using a shipping service of their choice or (ii) using the prepaid Colissimo return label provided by AKVO if the delivery was non-compliant.
Shipping costs are the responsibility of the Customer unless the delivery was non-compliant. The Customer must return the Products unused, undamaged, with their accessories, and in their original packaging so that AKVO can resell them.
Products that are not returned, or that are incomplete, damaged, altered, stained, or otherwise appear to have been worn or used, will not be refunded.
13. EFFECTS OF WITHDRAWAL
In accordance with Article L. 121-21-4 of the French Consumer Code, AKVO will refund the Customer for the returned Product(s), including standard delivery costs (unless the Customer selected a more expensive shipping option), minus any return shipping costs, within fourteen (14) days from the date AKVO was informed of the withdrawal. The refund may be delayed until AKVO receives the returned Product(s).
In the case of a partial return, delivery costs will not be refunded, as the Customer will have benefited from the delivery service for the retained Products.
Refunds do not include any banking fees incurred by the Customer when placing the order.
14. LEGAL WARRANTIES
The Products sold are covered by the legal warranty of conformity (Articles 217-4 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the French Civil Code).
If a lack of conformity is demonstrated, the Customer may choose to either have AKVO replace the Product with an identical one (subject to stock availability) or receive a refund of the Product’s price, along with delivery costs based on the total invoice amount, and return costs (upon proof).
If a hidden defect is demonstrated, the Customer may choose to receive either a full or partial refund of the Product price and delivery costs based on the total invoice amount, depending on whether they decide to keep the Product or not.
If the returned products do not match those ordered and originate from another source, AKVO will not be bound by the obligations outlined in this section.

15. INTELLECTUAL PROPERTY
Access to and use of the Site is strictly limited to the Customer’s personal use. Under no circumstances is the Customer authorized to download or modify all or part of the Site without AKVO’s express written permission.
Access to the Site does not grant the Customer any right to use, for sale or any other commercial purpose, the Site or its content (listed products, descriptions, prices, downloads, or copies of information for another merchant, use of data, software, sound clips, graphics, images, texts, photographs, tools).
The Site or any part of it must not be reproduced, copied, sold, or exploited for commercial or any other purposes, except to retain proof of the Customer’s order.
All elements of the Site, whether visual or audio, including underlying technology, are protected by copyright, trademarks, or patents and are the exclusive property of AKVO.
Creating hyperlinks to any pages or elements of the Site is also prohibited, as is any unauthorized use of the Site, particularly for commercial or professional purposes.
16. PERSONAL DATA
AKVO commits to complying with legal and regulatory requirements regarding data privacy, including the French Data Protection Act (Law No. 78-17 of January 6, 1978, as amended) and the European GDPR (Regulation (EU) 2016/679).
Each party is responsible for fulfilling the required formalities (declarations, authorization requests, etc.) with the relevant authorities and respecting the rights of individuals, including access, rectification, and deletion of personal data.

17. LIABILITY
AKVO is not liable for indirect, special, or incidental damages resulting from the Customer’s negligence, misuse, or improper use of any Products sold on the Site. Products must be used in accordance with the usage instructions provided.
Regarding site access, browsing, ordering, payment, and delivery, AKVO is only obligated to use reasonable efforts. It is not liable for internet-related disruptions or security breaches, including connection issues or malware attacks.
Additionally, AKVO is exempt from liability in cases of force majeure, such as strikes, postal service disruptions, transport issues, floods, or fires. AKVO’s liability is limited to the total value of the Customer’s order.
18. GENERAL CLAUSES

Headings in these General Terms and Conditions of Sale are for readability only and do not affect interpretation.
20. PARTIAL INVALIDITY
If any clause in these Terms is found to be invalid due to a law, regulation, or court ruling, the parties will negotiate a replacement clause. The remaining clauses remain in full effect.
21. NON-WAIVER
Failure by either party to enforce any provision does not constitute a waiver of that provision.
22. APPLICABLE LAW AND DISPUTES
These General Terms and Conditions of Sale are governed by French law.
Any disputes related to their validity, interpretation, execution, or termination, which cannot be resolved amicably, will be subject to competent courts under common law.
Customers may use a consumer mediator, as per Article L. 612-1 of the French Consumer Code, or the European Online Dispute Resolution platform:

Customers can accept or refuse mediation and, if unresolved, take legal action under French procedural law.
23. PRE-CONTRACTUAL INFORMATION
By placing an order on the Site, the Customer fully accepts the General Terms and Conditions of Sale and agrees to pay for the ordered Products, waiving any conflicting documents that would be unenforceable against AKVO.
